Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") are a legal agreement between you and BayWorks ("we", "us", or "our") governing your use of the BayWorks service at getbayworks.com and app.getbayworks.com. By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.

2. The service

BayWorks is shop-management software built for independent repair shops. It helps you track customers, vehicles, work orders, estimates, and invoices. We may update or change the service from time to time as we improve it.

3. Your account

You are responsible for keeping your account credentials secure and for all activity under your account. You agree to provide accurate information and to keep it current. You must be at least 18 years old to use the service.

4. Free trial and subscription

New accounts include a 14-day free trial with full features and no credit card required. After the trial, continued use requires a paid subscription at the rate shown when you subscribe ($49/month flat as of the date above). We will notify you before your trial ends.

5. Cancellation

You can cancel at any time, and cancellation takes effect immediately — no notice period, no cancellation fees. If you cancel, your data remains available for export, and your access to the paid features ends at the close of your current billing period.

6. Fees and billing

Fees are charged in advance for each billing period. All fees are stated in U.S. dollars. You are responsible for keeping your billing information current. We may change pricing with advance notice, and the change applies to your next renewal.

7. Your data

You own the data you enter into BayWorks — your customers, vehicles, work orders, and invoices remain yours. We use it only to provide the service to you, as described in our Privacy Policy. You can export your customers, work orders, and payments to CSV at any time.

9. Intellectual property

The BayWorks software, design, and brand are owned by us and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the service for your own shop during your subscription. Your business data remains yours, as stated in Section 7.

10. Disclaimer of warranties

The service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the service will be uninterrupted or error-free.

11. Limitation of liability

To the maximum extent permitted by law, BayWorks will not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill, arising out of or related to your use of the service. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim, or $100, whichever is greater.

12. Termination

You may stop using the service and cancel at any time. We may suspend or terminate your account if you violate these Terms, with notice where practicable. On termination, your right to use the service ends, and your data remains available for export for a reasonable period as described in our Privacy Policy.

13. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute will be resolved in the courts of California.

14. Changes to these terms

We may update these Terms from time to time. Material changes will take effect after we notify you, such as by posting the updated Terms here or by email. Your continued use of the service after the effective date means you accept the updated Terms.
